Social media has played a significant role in how information is shared and consumed in today's society. While these platforms offer a wide range of benefits, such as quick access to information and the ability to connect with people around the world, they also face challenges related to the spread of fake news.
With this in mind, this article aims to address the complex intersection between the role of social media in the dissemination of fake news and the fundamental right to freedom of expression. Furthermore, we will discuss the technical role of a lawyer in such cases.
This article seeks to examine the role of social media as facilitators of the spread of fake news and the legal issues related to this problem. The aim is to find a balance between the right to freedom of expression and protection against the harmful dissemination of false information, preserving the integrity of public debate and trust in sources of information.

Fake News and the Democratic Rule of Law System
The relationship between fake news and the democratic rule of law is complex and multifaceted. Fake news is deliberately misleading or false information presented as fact. It can be disseminated through various means of communication, such as fake news websites, social media, text messages, and even by authorities and political leaders.
Fake news can be used as a tool to manipulate public opinion. It can be designed to influence elections, defame political opponents, spread conspiracy theories, and create polarization in society. When people are exposed to false information, they may make decisions based on erroneous premises, compromising the integrity of democracy and the democratic rule of law.
Furthermore, the spread of fake news undermines trust in democratic institutions, such as the press, the government, and the judicial system. When people cannot distinguish between true and false information, their trust in institutions and in the ability of the democratic system to provide accurate and reliable information is shaken. This can lead to a significant weakening of democracy.
The last elections saw numerous instances of fake news , where the Judiciary often had to act as a countermeasure against the dissemination of false information. Furthermore, I want to make it clear that I am not referring to a specific candidate, but rather to the elections as a whole, given the numerous cases involved.
In this sense, democracy depends on a foundation formed by citizens who can make political decisions in a conscious and informed way; that is why the population always needs to consume truthful information, so that decisions are always based on truth.
However, when fake news spreads, citizens may make decisions based on false information. Thus, misinformation can distort an individual's perception of reality.
Thus, although freedom of expression is a fundamental principle of democracies, fake news presents challenges in this area. Sometimes, freedom of expression is used as an excuse to spread fake news.
Freedom of expression
Freedom of expression refers to the fundamental right to express opinions, ideas, and thoughts without state interference, assuming responsibility for any moral, material, and reputational damage.
In Brazil, freedom of expression is a fundamental right guaranteed by the 1988 Federal Constitution. It is stipulated in Article 5, sections IV and IX, which establish that:
IV – Freedom of expression is guaranteed, anonymity being prohibited.
IX - Freedom of intellectual, artistic, scientific, and communicative expression is guaranteed, regardless of censorship or licensing.
Even while prescribing freedom of expression, item IV of article 5 is categorical in establishing a prohibition: anonymity. This is because, while the Constitution guarantees free speech, it also protects the right of reply, in addition to compensation for material, moral, or reputational damage. This is in accordance with item V of the same article:
V – the right to reply, proportional to the offense, is guaranteed, in addition to compensation for material, moral or reputational damage;”
If the victim of a speech has the right to seek redress, then the offender must be identified, hence the prohibition of anonymity. In the age of social media, with the common use of fictitious users who spread offenses, insults, and fake news , the illicit use of freedom of expression has become constant.
The deliberate dissemination of false information is not protected by freedom of expression, as it can cause significant harm to society. However, balancing the restriction of misinformation with the guarantee of freedom of expression is a complex challenge and can lead to debates about censorship and media control.
In this sense, given these challenges, it is important to adopt approaches to combat fake news in a democratic context. Important measures to be adopted by society include media transparency and the development of critical thinking among citizens. These are essential behaviors to empower people to identify and evaluate false information.
Furthermore, major social media platforms such as Facebook, Instagram, and Twitter play a crucial role in the spread of fake news, as it is through them that this news ends up being reproduced. Therefore, they must take responsibility for monitoring and limiting the spread of misleading information on their platforms.
The Role of Social Networks in the Dissemination of Fake News
Social media has played an increasingly important role in our daily lives, including how we consume and share information. However, this ease of access to information has also brought the problem of fake news. Unfortunately, social media has become fertile ground for the spread of misinformation and deliberate disinformation, often with significant consequences for society.
Both types of information have the potential to cause real harm to society, whether intentional or not. When people believe fake news or rumors, they may make poor decisions based on incorrect information. This can have a negative impact on various areas of life.
In May, Bill 2.630/2020 was introduced in the Federal Senate with the aim of combating the spread of false information and holding platforms accountable for any non-compliance. Popularly known as the Fake News Law , the bill was proposed by Senator Alessandro Vieira (CIDADANIA – SE) and defined as the Brazilian Law of Freedom, Responsibility and Transparency on the Internet.
In this sense, norms, guidelines, and transparency mechanisms are established for social media and private messaging service providers in order to guarantee security, broad freedom of expression, communication, and the manifestation of thought. Its objective is to hold digital platforms accountable for combating disinformation and the spread of fake news . The impasse has not yet been approved and awaits deliberation.

Role of the Technical Defense
It is important to emphasize that the role of a lawyer is to guarantee the defense of their client's rights and interests, respecting the ethical and legal principles that govern the profession. The lawyer must meticulously analyze the facts of the case, investigating the circumstances in which the dissemination of false news occurred.
This may include examining evidence, such as documents, internet records, or witness statements, to gain a clear understanding of the case. The legal defense must ensure that the accused's fundamental rights are protected throughout the process. This includes the right to the presumption of innocence, the right to a fair trial, the right to a full defense, and the right to present counter-arguments.
It is important for the legal defense to verify the authenticity of the information supporting the accusations of spreading fake news. This may involve hiring experts or conducting technical audits to examine the origin and veracity of the information disseminated.
Based on an analysis of the facts and verification of the authenticity of the information, the lawyer will be able to present solid defense arguments. This may include demonstrating that there was no intent to defame or deceive, that the disseminated content is not falsified, or that the accused was not directly responsible for spreading the false news.
Finally, it is worth noting that defense strategies may vary according to the legislation and procedures adopted in each specific case. The essential point is that the lawyer must always act within the permitted ethical limits.
