Here on the IDP Blog , we frequently cover topics related to Regulatory Law.
We present it as a growing branch of law , responsible for establishing the rules and parameters for the functioning of strategic sectors of the economy.
In today's article, we will continue to deepen our understanding of regulatory frameworks in Brazil, focusing on new technologies.
Come on!
Regulation: an essential part of how the State functions.
In Brazil, there are several forms of regulation, each geared towards different sectors and activities. Each has its own laws, regulations, and bodies responsible for overseeing and enforcing the rules.
It is important that regulation be efficient and fair to ensure the well-being of society and the proper functioning of public and private institutions and services.
When discussing new technologies, it is always necessary to ensure that their development and use are carried out safely, ethically, and in accordance with current laws and regulations.
The process of regulating new technologies in Brazil can vary depending on the sector in which the technology is used. Some of the main forms of regulation in Brazil include:
- Economic and Financial Regulation: Economic regulation aims to control the economy and markets, ensuring free competition and preventing anti-competitive practices.
Financial regulation, on the other hand, is responsible for overseeing the financial system, banking institutions, investments, and financial transactions.
In this sector, one technology that has advanced and is being increasingly improved is Pix and its security mechanisms, especially considering the new forms of fraud that are being applied throughout Brazil.
Another reality made possible by technology in the economic and financial sector is Open Banking.
This concept refers to the opening and sharing of customer financial data between different financial institutions through APIs (Application Programming Interfaces).
This sharing of information allows customers to have more control and access to their own banking data, as well as enabling the integration of financial services and products from different institutions.

- Environmental Regulation: It focuses on protecting the environment and ensuring the sustainable use of natural resources. The main objective of environmental regulation is to guarantee a balance between economic growth and environmental conservation, ensuring the quality of life for present and future generations.
Various government agencies have responsibilities in environmental regulation at different levels. The Ministry of Environment and Climate Change (MMA) is responsible for formulating and coordinating national environmental policies.
Brazil also has an extensive network of conservation units, which are protected areas with different levels of restrictions and objectives for preserving biodiversity and ecosystems.
New technologies in the environmental field range from the digital inclusion of small farmers and family farmers to the expansion of carbon credits as an increasingly tokenized green currency.
Furthermore, new technologies aimed at producing clean and sustainable energy are being regulated by the Ministry of Mines and Energy – MME.
The agency even launched a study in November 2021 called " Use of new digital technologies for measuring energy consumption and energy efficiency levels in Brazil . "
- Regulation of Public Services: It involves the oversight and definition of rules for essential services provided to the population, such as electricity, water, public transportation, basic sanitation, among others.
The goal of regulation is to ensure that these services are offered adequately, with quality, efficiency, equity, and at fair prices, guaranteeing consumer rights and promoting social well-being.
Regulatory agencies, such as the National Electric Energy Agency – ANEEL , the National Telecommunications Agency – ANATEL , and the National Water and Basic Sanitation Agency – ANA, have the function of regulating these sectors.
Regulatory agencies also have the function of overseeing the quality of services provided by companies, ensuring that established rules and standards are met and that consumers receive adequate services.
Specifically in the field of new technologies, ANATEL stands out.
At the 3rd TelComp Symposium – Telecom, Technology and Competition for the Digital Future , held by TelComp (Brazilian Association of Competitive Telecommunications Service Providers) in partnership with IDP in Brasília/DF in June 2023, the executive superintendent of ANATEL stated that "New technologies and technological development are in the institution's DNA," as is the Metaverse.
- Health Regulation: It involves the oversight and regulation of healthcare services, such as hospitals, clinics, and health insurance plans.
The aim is to guarantee universal, equitable and quality access to health services, as well as to promote the protection of the population's health and the development of actions for prevention and health promotion.
The Unified Health System – SUS is the main foundation of Brazil's health system, a public and free system that offers health services to the entire population. It is organized into three levels of government: federal, state, and municipal, each with its own responsibilities in managing and financing health actions.
When it comes to new technologies that challenge regulation in the health sector, we can cite biotechnology and the possibility of developing personalized medicines. Also on the horizon is the 3D printing of organs, under joint regulation with the National Health Surveillance Agency – Anvisa.
- Regulation of Education: It focuses on establishing guidelines for the provision of education in the country, including defining curricula and regulating educational institutions.
The goal is to guarantee the quality of education, equal opportunities, the appreciation of education professionals, and the organization of the country's educational system.
This regulation covers all levels of education, from early childhood education to higher education, and is the responsibility of federal, state, and municipal governments.
The Ministry of Education – MEC is the body responsible for regulating and authorizing the operation of educational institutions, whether public or private. The accreditation and authorization process takes into account criteria such as the quality of the courses and the infrastructure of the institutions.
The federal government, along with state and municipal governments, must implement educational programs and policies aimed at improving the quality of education, promoting teacher training, expanding access to education, and reducing educational inequalities.
EdTechs, which are startups aimed at creating and developing new technological solutions, are increasingly gaining traction here .
These range from virtual learning platforms with online classes and training courses, to customized applications and software, and even extend to the development of solutions using artificial intelligence, virtual reality, gamification, and data analysis.
