Among the public functions established by the Constitution, some are dedicated to overseeing expenditures made by the Public Authorities. Although the judgment of the Union's accounts depends on analysis by the Legislative Branch, the Federal Court of Accounts (TCU) acts as an external control body for the federal government.

The TCU (Brazilian Federal Court of Accounts) plays a fundamental role in overseeing public administration in Brazil, especially with regard to bidding processes and administrative contracts.

The TCU and its role in public administration.

As an external oversight body linked to the Legislative Branch, its decisions directly impact how the public administration conducts its procurement processes, ensuring that the constitutional principles that guide Public Administration (legality, impartiality, morality, publicity, efficiency, and economy) are respected.

This influence is exerted through both preventive and repressive actions, ensuring greater transparency and mitigating the risks of deviations and irregularities in public procurement and contracting processes.

Public bidding processes and administrative contracts are essential instruments for the Public Administration to guarantee the execution of public policies, the supply of goods and services, and the carrying out of works, in order to fulfill its constitutional duty.

However, these activities are subject to various rules and principles aimed at preventing illegal practices, such as fraud and overpricing.

In exercising its oversight function, the TCU (Brazilian Federal Court of Accounts) analyzes the compliance of bidding and contractual procedures with current legislation, and may determine the annulment of irregular bidding processes, the application of sanctions to managers and companies, and even the blocking of financial transfers for certain contracts.

Furthermore, the TCU (Brazilian Federal Court of Accounts) also has the function of overseeing contractual relationships between the Federal Government and its employees, whether they are governed by the CLT (Consolidation of Labor Laws) or by statutory law. Since the payment of salaries and bonuses depends on budgetary allocations, oversight is necessary to prevent irregularities.

Thus, their actions not only correct flaws but also prevent future irregularities by creating an environment of greater rigor and accountability in public administration.

The decisions of the TCU (Brazilian Federal Court of Accounts) in the legal system.

When addressing this topic, some legal experts encounter a certain blockage regarding the legal nature of the decisions issued by the TCU (Brazilian Federal Court of Accounts).

The decisions of the TCU (Brazilian Federal Court of Accounts) have a practical normative effect, as they guide the conduct of public managers and private agents participating in bidding processes. The Court's jurisprudence is also frequently used as a reference for the interpretation and application of the rules governing public procurement. In short, the TCU's function is to direct the behavioral standard in matters of public law.

Thus, even if their decisions are not binding in all cases, they end up influencing public administration by establishing guidelines on controversial issues, such as the disqualification of companies, the rejection of proposals, the need for detailed justification for certain choices, and the requirement for greater competitiveness in bidding processes.

One of the main impacts of the TCU's decisions is the creation of administrative jurisprudence on the application of the Law on Bidding and Administrative Contracts, recently reformulated by Law No. 14.133/2021. The Court has expressed its opinion on topics such as the mandatory detailed planning of contracts, the prohibition of irregular splitting of expenses to avoid bidding, and the need for broad publicity and transparency in contracting.

These interpretations directly influence how managers draft bidding documents and conduct selection processes, ensuring they comply with the most up-to-date understandings on the subject.

Furthermore, the TCU (Brazilian Federal Court of Accounts) has been an active agent in promoting efficiency in public procurement. Its audits and inspections frequently identify flaws in contracts that result in the waste of public resources.

A practical example is the auditing of public works contracts, in which the Court verifies the compatibility of the contracted values with market prices, preventing overpricing. Decisions ordering the revision of administrative contracts to adapt them to more advantageous technical and financial parameters for the administration are also common, promoting economy and efficiency in the management of public resources.

Another relevant aspect of the TCU's decisions is their impact on the accountability of public managers. When irregularities are identified in bidding processes or in the execution of administrative contracts, the Court can apply penalties ranging from fines to disqualification from holding public office. This individual accountability of public agents contributes to strengthening control and governance in the public sector, since it imposes a greater degree of diligence in administrative decision-making.

Companies that participate in bidding processes and enter into contracts with the public administration are also heavily impacted by the decisions of the TCU (Brazilian Federal Court of Accounts), given that the Court has the power to declare companies involved in fraud or other illicit practices ineligible, preventing their participation in future contracts with the Public Sector. This measure has an important deterrent effect, as it serves as a barrier to opportunistic behavior and encourages compliance with the rules stipulated in the bidding documents and contracts.

Furthermore, the TCU's decisions regarding eligibility criteria and the evaluation of proposals frequently result in changes to the requirements for participating in bidding processes, forcing companies to adapt to new technical, financial, and documentary parameters.

The digitization of administrative processes and the advancement of public transparency are also topics addressed by the TCU (Brazilian Federal Court of Accounts) in its decisions. The Court has encouraged the use of technological tools to improve the oversight of contracts, such as electronic purchasing systems, shared databases among control bodies, and automated audit mechanisms. This demonstrates a continuous movement to modernize administrative procedures and make public management more efficient and accessible to society.

However, the TCU's actions are not without criticism. Some public managers argue that the excessive rigor in audits and the possibility of individual accountability create an environment of legal uncertainty, leading to the so-called "paralysis of decision-making," in which public officials avoid making decisions to avoid the risk of being penalized in the future.

Similarly, there is criticism regarding the delay in judging administrative processes, which can compromise the execution of contracts and create obstacles in the provision of essential services.

Finally, it should be noted that excessive rigor, to some extent, creates constraints that prevent the organic advancement of the Public Power, in the same pace as society. These challenges highlight the need for a balance between control and efficiency in public administration.

CONCLUSION

In short, the decisions of the Brazilian Federal Court of Accounts (TCU) have a significant impact on bidding processes and administrative contracts in Brazil. By establishing guidelines, correcting irregularities, and holding public officials and companies accountable, the TCU strengthens the principles of public administration and contributes to transparency and efficiency in the management of public resources.

However, it is essential that its actions be guided by a balance that allows for rigorous oversight without compromising the efficiency and speed of administrative processes. The role of the TCU (Brazilian Federal Court of Accounts) will continue to be central in building a more ethical and effective public administration, ensuring that contracts are conducted fairly and for the benefit of society.
