In recent years, the sports betting market in Brazil has undergone significant changes, driven by technological advancements and the growing popularity of digital platforms.

The legalization and regulation of this sector opened up new economic opportunities, while at the same time bringing challenges for the government and society, especially in the tax and regulatory fields.

Law No. 13.756/2018 represented the first step towards organizing the fixed-odds betting market, but gaps related to constitutional aspects still needed to be filled, mainly in taxation and consumer protection.

In response, new regulations, such as Provisional Measure 1.182/2023 and Constitutional Amendment No. 132/2023, introduced essential measures, including the creation of a selective tax, with the potential to affect digital betting, seeking to reconcile revenue collection and control of risky behaviors.

Regulation also seeks to mitigate social impacts, such as gambling addiction, and ensure a fair and competitive market. A balance between economic growth and social responsibility is essential to prevent sports betting from causing harm to public health and permanently compromising the financial integrity of consumers and the country.

Context of sports betting regulation in Brazil

The structuring of the Brazilian betting market began with Law No. 13.756/2018, which allowed the operation of fixed-odds betting. However, it was only in 2023 that new legal frameworks filled important gaps, with the enactment of Provisional Measure 1.182/2023 and Constitutional Amendment No. 132/2023.

These regulations brought greater clarity to the sector, defining:

  • Authorizations for legal operationCompanies need to obtain authorization to operate.
  • Sanctions and strict enforcementMeasures to prevent fraud and ensure transparency.
  • excise tax: focused on discouraging the consumption of goods and services that are harmful to health and the environment.

These initiatives are fundamental to encouraging the formal market and protecting consumers, ensuring that tax revenue translates into social benefits.

The role of selective taxation in sports betting.

Selective taxation is a fiscal tool of an extra-fiscal nature , meaning it goes beyond revenue collection: it seeks to regulate behaviors considered harmful. Inspired by the American " sin taxes ," applied to products such as alcohol and tobacco, this tax aims to discourage practices that are detrimental to health and social well-being.

In the case of sports betting, selective taxation can primarily serve two functions:

  1. Reducing harmful practicesThe tax has the potential to discourage gambling addiction by imposing an additional cost.
  2. Revenue collectionThe resources can be allocated to priority areas such as health and education.

Complementary Bill No. 29/2024 defines the rates and guidelines for the application of the selective tax, ensuring that taxation is transparent and fair, in accordance with the fundamental rights and guarantees enshrined in the Constitution.

Economic impacts of taxing sports betting.

With projected annual revenue between R$6 billion and R$12 billion , the taxation of sports betting represents a significant source of revenue for the government. Taxing net winnings to bettors at a rate of 15% income tax is a measure to ensure that the State participates in the generated profits.

However, it is essential that the tax burden does not make the formal market unviable. Imposing excessive taxes can encourage the use of illegal platforms , where there is no taxation or oversight, harming revenue collection and consumer protection.

According to the Central Bank , in August 2024 alone, beneficiaries of the Bolsa Família program transferred R$ 3 billion to gambling platforms . These figures reveal the social impact of gambling and demonstrate the need for effective policies to protect vulnerable populations from harmful practices.

Legal issues involved in the taxation of sports betting.

Taxation of the betting market also faces legal challenges. Selective taxation must be applied cautiously to avoid violating Article 3 of the National Tax Code , which prohibits taxes with confiscatory effect. Furthermore, it is crucial to clearly define the tax base , avoiding legal conflicts and ensuring predictability for operators and bettors.

Another issue is the cumulative application of PIS and Cofins , which are added to the 12% contribution on gross gaming revenue (GGR) . The Constitution provides for a specific social security contribution based on revenue from prediction contests, which may generate debates about the constitutionality of this additional taxation.

Taxation of gamblers' winnings

The new legislation also brought changes to the taxation of prizes won by bettors . The 15% tax rate is applied to net annual prizes, after deducting losses accumulated over the period. This change prevents bettors from being penalized for one-off wins while accumulating losses over time.

With this measure, the government seeks to prevent bettors from migrating to illegal platforms, where there is no tax liability. Revising the annual tax assessment system is essential to ensure fiscal fairness and encourage the use of regulated platforms.

Operational and technological challenges in inspection.

Regulating the digital betting market presents technological challenges . Many operators are based in countries with more permissive legislation , making it difficult to apply Brazilian laws. Furthermore, the use of cryptocurrencies in betting represents an additional obstacle, as these transactions are more difficult to trace.

To overcome these challenges, it is necessary to invest in advanced monitoring technologies and establish international partnerships . Cooperation between tax authorities and operators is fundamental to preventing tax evasion and ensuring market transparency.

Social impact and the need for awareness.

The case of Bolsa Família beneficiaries who spent R$ 3 billion on gambling in a single month highlights the urgent need for awareness campaigns and social protection measures.

It is crucial that regulations include responsible gambling mechanisms, preventing compulsive behaviors from worsening the financial situation of vulnerable families.

The regulation should also ensure that the funds raised from the selective tax are allocated to financial literacy and public health programs , promoting responsible use of betting platforms.

The importance of fiscal policies and their impact on the betting sector.

While essential, regulating the sports betting market and imposing taxes are not isolated solutions to the sector's challenges. These measures need to be accompanied by structured fiscal policies, ensuring that revenue collected through taxation is directed towards social programs and financial literacy initiatives, especially those aimed at vulnerable populations.

The effectiveness of these policies depends on transparency in revenue collection and cooperation between the government and operators. An efficient tax system, coupled with awareness campaigns, contributes to the sustainability of the market, maintaining public revenue without harming economic growth.

Conclusion

The taxation and regulation of sports betting in Brazil represent an essential milestone for the organization of this growing market. The creation of this selective tax, in addition to raising revenue, aims to mitigate social risks such as gambling addiction, promoting a responsible and transparent gaming environment.

These measures seek to balance economic growth with consumer protection, ensuring that the sector develops without compromising public health.

For regulation to be effective, an efficient and fair tax system is essential, one that maintains the competitiveness of the legal market and prevents migration to unregulated platforms.

Transparency in tax collection, coupled with appropriate fiscal policies and consumer awareness, will ensure that the resources obtained are directed to social programs, public health, and financial education, especially in support of the most vulnerable populations.

With proper implementation and continuous oversight, the sports betting market could consolidate itself as an important source of public revenue. Thus, the regulation of sports betting in Brazil will promote not only economic development, but also a safe and sustainable environment, contributing to the financial stability and social well-being of the country.
