The Criminal Precedents Observatory research group aims to analyze precedents of the Brazilian Supreme Federal Court in criminal and criminal procedure matters, especially regarding general repercussion and concentrated control of constitutionality, in addition to the growing importance of the formation of criminal jurisprudence in habeas corpus proceedings. Using a systematic methodology for analyzing criminal cases, the group aims to create a consistent database to support theoretical and empirical research on criminal and criminal procedure dogmatics. Thus, it intends to contribute to the development of criminal dogmatics and to the construction of a criminal procedure dogmatics in accordance with constitutional and conventional dictates for the effective protection of fundamental rights. Research lines:
– Fundamentals of Constitutional Review and Precedents in Criminal Matters: a study of the premises of constitutional review of criminal and criminal procedural laws, as well as the formation and application of precedents in criminal matters; – Criminal Dogmatics and Precedents in Substantive Criminal Law: a systematic analysis of precedents in substantive criminal law and research in criminal dogmatics;
– Procedural criminal law dogmatics and precedents in criminal proceedings: a systematic analysis of precedents in criminal proceedings and research in procedural criminal law dogmatics.
