About the study group

The Privacy and Data Protection in the Superior Courts research group aims to explore the interpretation and application of Brazilian Superior Courts, especially the Supreme Federal Court (STF) and the Superior Court of Justice (STJ), regarding the protection of personal data. Through the analysis of relevant court decisions, the group seeks to understand the maturation of the General Data Protection Law (LGPD) and the recognition of data protection as a fundamental right, investigating trends and challenges in this area. In this way, the group intends to contribute to strengthening a solid, privacy-centered legal approach, with the potential to influence practices in the public and private sectors, and consolidating a more robust and modern legal framework in Brazil.

Group proposal

This research group aims to explore the interpretation and application of Brazilian Superior Courts regarding data protection, analyzing relevant decisions from the Supreme Federal Court (STF) and the Superior Court of Justice (STJ). The maturation of the LGPD (Brazilian General Data Protection Law) and the recognition of data protection as a fundamental right point to an evolving jurisprudence that balances technological innovation and fundamental rights. This research group will analyze the trends and challenges of data protection in Brazil based on the jurisprudence of the Courts, contributing to the strengthening of a secure legal approach centered on privacy, influencing practices in the public and private sectors, thus consolidating a more robust and modern legal framework in Brazil.
