About the study group

The RCPC aims to continuously study Brazilian civil liability – its functions, assumptions, and trends – in comparison with other civil law and common law systems.

Group proposal

The group focuses its research on comparing the "state of the art" of Brazilian civil liability with its advancements in European civil law systems and common law jurisdictions. To this end, we will analyze the functions of civil liability, its dialogue with philosophy, economics, and public policy. We will address tort and contractual liability, analyzing the assumptions of the subjective and objective theories of civil liability. We will also address specific types of civil liability, examining its intersections with technology, data protection, medical law, bioethics, family law, business law, consumer law, environmental law, state responsibility, and other interactions with economic activities.
