IDP professors Nelson Rosenvald, Atalá Correia, and Adisson Leal are launching the 2nd edition of the book "Civil Liability – New Trends".
"The topic of 'civil liability' is one of the most intriguing in Law. Yesterday and today it challenges countless perspectives, constantly increased by the hypercomplexity, uncertainties, and mutability of social phenomena. There is even discussion about the possible overcoming of the assumptions of civil liability and its functions. The initiative of this book, bringing together renowned professors and researchers, had no other purpose than to foster continued debate on this rich and difficult subject."
In an elegant preface, Donal Nolan, Professor of Private Law at the University of Oxford, offers the entire academic community an engaging comparative approach. The author rightly points out that the concept of "tort" cannot, without due reservations and nuances, be transferred to the "Civil Law" system. Within the "Common Law" system, he highlights the strength and scope of the "duty of care," concluding that this book has much to contribute to comparative law. Although legal systems have their specificities, the contributions are reciprocal and desirable.
"For the sake of better organization, we have divided the work into the following groups: a) principles and foundations of civil liability; b) assumptions and modalities of civil liability; c) environmental civil liability and civil liability in consumer relations; d) civil liability in family law; e) civil liability in the medical field; f) civil liability of cigarette manufacturers; g) civil liability of notaries and registrars; h) civil liability of the State. As with any choice, we assume the natural risks of other possible proposals. In any case, we emphasize that we have used the predominant themes for this division, without disregarding the cross-cutting nature of the subject."
