ABSTRACT
There has been much discussion regarding the nature of advances on foreign exchange contracts (ACC) when they are held by a company undergoing bankruptcy proceedings. While financial institutions argue that these constitute their own resources held by the bankrupt – a position agreed upon by the Superior Court of Justice (STJ) in issuing Ruling No. 307 – some legal scholars believe they are credits that should form part of the bankruptcy estate. The objective of this article is to present the arguments of both positions and suggest criteria for addressing ACCs. The development of the discussion points to disagreement with the content of Ruling 307. In conclusion, it is suggested that the rule requiring ACCs to be returned before the payment of any bankruptcy credit challenges the constitutional principles of equality, procedural efficiency, and business preservation, and advocates for their classification as unsecured credits.
