The Personal Data Protection Treaty was organized by individuals who played a leading role during the formative process of the LGPD (Brazilian General Data Protection Law) in Brazil. Designed to provide readers with up-to-date and solid sources, offering both theoretical depth and practical application on the main topics and issues related to data protection, its articles were written by highly qualified legal professionals representing not only academia but also all legal careers and specialties.

Readers of the Personal Data Protection Treaty now have in their hands a work that provides a comprehensive analysis of the practical implications of applying the LGPD (Brazilian General Data Protection Law) and interpreting the entire set of regulations in question. The project coordinators, including professors Laura Scertel and Danilo Doneda (directors of CEDIS), played a leading role throughout all phases of the LGPD's formative process and the maturation of the data protection culture in the country, which gives the book a distinctive character in this respect as well.

The book is divided into three parts. The first part addresses the historical and theoretical foundations of the development of the discipline related to the protection of personal data, both in Brazil and in foreign legal systems, as well as its constitutional foundations.

The articles in the second part focus on the LGPD (Brazilian General Data Protection Law), including contributions on its structure and creation. This section discusses the respective chapters and provisions of the law, such as the principles of the legislation, data processing requirements, an overview of data processing by the Public Sector and private companies, civil liability, normative dialogues with other laws, the exercise of rights by data subjects, impact assessment of data processing, information security, and other topics.

The third part, in turn, contains texts on current, relevant, and challenging topics that, for a more systemic and complete view, could not be left out of the work. This is the case with the concept of privacy by design, algorithm-based decisions, the connections between data protection and other branches of law – such as competition and labor law –, the applications of data protection in scientific research, intellectual property, public security, immigration processes, political campaigns, health, among others.

All texts underwent a final review and update to incorporate the legislative innovations of 2020, especially Law 14.010/2020 and Decree 10.474 of 2020, ensuring their utmost timeliness and quality.

The book is now available for purchase on the Editora Forense website; access the book here. clicking here.
