"With the aim of making litigation in Brazil more efficient, bringing it closer to socially desirable levels, the 2015 Code of Civil Procedure provided for or improved four important procedural institutes: conciliation and mediation; precedent system; fines and attorneys' fees; and the attribution of binding effects to extraordinary appeals with general repercussion that have been stayed. Based on the theoretical framework of Economic Analysis of Litigation and through applied research, adopting the hypothetical-deductive method, it is concluded that, although the aforementioned institutes have not immediately resulted in an improvement in the country's litigation rates, they present themselves as mechanisms to discourage frivolous litigation, including merely dilatory appeals, by seeking self-composition solutions, minimizing the bias of optimism and reducing information asymmetry."
The economist, who is pursuing his second law degree at IDP, explains how he arrived at the topic of the article. “The inspiration came from the lack of articles analyzing, with quantitative data, the effectiveness of the Code of Civil Procedure. One of the main objectives of the law was to make litigation levels in Brazil more efficient, which are currently quite high. The article aimed to evaluate the impacts of this law from that perspective,” the student comments.
The economist concludes by recounting the process for publishing the article. “The article is the result of the IDP's Scientific Initiation Program. I was a scholarship recipient, and my advisor, co-author of the article, guided me in constructing the research problem. I already research in the area of Economic Analysis of Law and Civil Procedure, he was also researching in the area, and we ended up building the article together. After presenting the article at IDP, we sought the UERJ journal to publish the article; they only requested some formal adjustments and published it last week.”
According to IDP Professor Victor Guedes Trigueiro, a Federal Attorney and João Paulo's advisor, publishing articles during undergraduate studies is of great importance. "For those interested in investing in research and pursuing an academic career, the sooner the student becomes aware of this, the better. By the end of the course, the student will already have experience, will find it easier to complete their thesis, and will certainly have advantages at the beginning of their career," explains the professor.
