In her presentation, Professor Marion highlighted the growing difficulty in differentiating between personal and non-personal data, emphasizing the importance of rethinking such categorizations in light of the new possibilities for data use and processing afforded by technology. The European rules concerning the right of access to information, the right to review automated decisions, and the right to an explanation of algorithmic decisions were addressed in detail, explaining the concrete difficulties in exercising these rights in light of the technological dynamics themselves and the interpretation given to them by the Judiciary. Specifically regarding decisions made by algorithms, the importance of adding additional rules based on the principle of "accountability" to existing individual rights was discussed, taking into account the procedural dimension of personal data protection. Finally, Professor Marion Albers discussed the idea of creating independent supervisory authorities specifically focused on Artificial Intelligence.
The lecture also marked the beginning of the activities of the IDP's Research Group on Personal Data Protection, led by professors Laura Schertel, Danilo Doneda, and Miriam Wimmer. The Research Group will meet monthly, featuring lectures by expert professors on the subject and providing opportunities for debate and in-depth academic study on different aspects of personal data protection in Brazil and around the world.
