IDP Professor Bruno Torrano launched the 2nd edition of his book "Democracy and Respect for the Law" at the beginning of February. In the work, the Professor explains misunderstandings about legal positivism that are still disseminated in Brazilian doctrine and jurisprudence, thus helping us to visualize which theses of this important legal theory are useful for clarifying and improving our legal practices.
The IDP professor, who holds master's degrees in Philosophy of the State and Business Law, explains that he arrived at the topic of the work after thoroughly studying Brazilian Post-positivism. "I realized that Brazilian Post-positivism is a theory that, in addition to overestimating its own capabilities and achievements, provides judges with various rhetorical devices to give the appearance of legality to arguments that, in reality, are nothing more than personal predilection," explains the professor.
According to the Professor, the work has two objectives. “The work has the dual purpose of recovering the theoretical dignity of legal positivism and asking magistrates to once again take seriously notions such as institutionality and the authority of law. In short, the work asks them to stop repeating the mantra 'we are in post-positivist times' if this serves only as a rhetorical and quick way to rid themselves of the duty to be guided by rules and to respect the legal-constitutional framework,” adds the Professor.
